E-Bike Rental Agreement & Release of Liability

BETWEEN: [West Coast E-bikes Inc.] (the "Company")

AND: The individual(s) listed below (the "Renter")

1. RENTAL EQUIPMENT & CONDITION

The Renter acknowledges receipt of the electric bicycle(s) and associated equipment (helmets, locks, chargers) (collectively, the "Equipment") in good working order. The Renter agrees to return the Equipment in the same condition, ordinary wear and tear excepted.

2. CREDIT CARD AUTHORIZATION & DAMAGES

2.1 Right to Charge: The Renter hereby authorizes the Company to charge the credit card on file for any of the following:

  • The full retail replacement value of the Equipment if it is lost, stolen, or not returned by the agreed time.

  • The cost of all repairs, parts, and labor required to restore the Equipment to its pre-rental condition if damaged.

  • Any outstanding rental fees, late fees, or provincial/municipal traffic fines incurred during the rental period.

2.2 Collection: If the credit card on file is declined or insufficient, the Renter agrees to pay all costs of collection, including reasonable legal fees and court costs.

3. OPERATING REQUIREMENTS (BC LAW)

The Renter warrants and agrees that:

  • Age: They are at least 16 years of age (required for standard 500W e-bikes in BC).

  • Helmets: They will wear a CSA, ANSI, or ASTM approved helmet at all times while operating the e-bike, as required by the BC Motor Vehicle Act.

  • Rules of the Road: They will obey all BC provincial and municipal traffic laws. E-bikes are treated as bicycles and are prohibited on most sidewalks.

  • Sobriety: They will not operate the Equipment under the influence of drugs or alcohol.

4. RELEASE OF LIABILITY & WAIVER OF CLAIMS

PLEASE READ CAREFULLY – BY SIGNING THIS, YOU ARE GIVING UP LEGAL RIGHTS.

4.1 Assumption of Risk: I am aware that e-biking involves inherent risks, dangers, and hazards, including but not limited to: mechanical failure, changing weather, uneven terrain, collisions with pedestrians or vehicles, and negligence of other operators. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS.

4.2 Waiver: In consideration of the Company renting me the Equipment, I hereby agree:

  • TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the Company, its directors, employees, and agents (the "Releasees").

  • TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense, or injury, INCLUDING DEATH OR DISMEMBERMENT, that I may suffer as a result of my use of the Equipment, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, breach of contract, or breach of any statutory or other duty of care on the part of the Releasees.

4.3 Governing Law: This Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia. Any litigation shall be brought exclusively within the Courts of British Columbia.

5. SIGNATURES

I HAVE READ AND UNDERSTAND THIS AGREEMENT. I AM AWARE THAT BY PAYING FOR THIS RENTAL I AM WAIVING CERTAIN LEGAL RIGHTS.
